Why You Need Uninsured/Underinsured Motorist Coverage

Why You Need It If you’re in an accident and the other driver is uninsured or doesn’t have enough insurance, will you be covered? If you have uninsured/underinsured motorist protection (UM/UIM), the answer is probably “yes.” Many auto insurance industry experts recommend choosing this option. You might think that because your state requires auto insurance, most people have it. However, Alabama has one of the highest rates of uninsured drivers in the entire country. What Is UM or UIM? Uninsured or underinsured motorist coverage can pay for injuries to you and your passengers when there is an accident and the other driver is both legally responsible for the accident and considered “uninsured” or “underinsured.” An uninsured driver is someone who did not have any insurance, had insurance that did not meet Alabama’s minimum liability requirements, or whose insurance company denied their claim. A hit-and-run driver is also considered an uninsured driver under Alabama law. An underinsured driver is someone who met minimum legal financial responsibility requirements but did not have payment limits high enough to cover the damage they caused. In these cases, UM or UIM can pay you for your damages. Is UM/UIM Required? Alabama does not require UM/UIM […]

What Is an Umbrella Insurance Policy?

What is an umbrella policy? How much coverage do I need? When you buy a house or a car or open a business, you may decide to purchase the minimum required insurance coverage. Such coverage may be sufficient after a minor fender-bender or if your roof is damaged by hail. However, what if something catastrophic happens? In such cases, basic liability coverage in your home and auto insurance policies may not cover the full amount of a large settlement or verdict. Suddenly, every asset you have could be at risk. A court’s decision could take away your current savings, a portion of your future wages and even your house itself. When you have assets you can’t afford to lose, consider an umbrella liability policy. Umbrella insurance provides extra coverage over and above your existing liability limits and pays out once your main liability coverage has been exhausted. How Much Does Umbrella Insurance Cost? Typically, you’ll pay around $150 to $300 annually for $1 million in umbrella coverage, according to the Insurance Information Institute. While $1 million is the standard minimum for an umbrella policy, you also can opt for larger amounts of coverage in million-dollar increments. To be eligible for […]

So You Think You Have “Full Coverage” Auto Insurance?

A “full coverage” policy typically has 3 components: Liability coverage, which pays for injury to another motorist or damage to another car. Alabama requires that drivers have a minimum amount of $25,000 in liability coverage. Collision coverage, which pays for physical damage to your car if you run into something, such as another vehicle or a tree. Comprehensive coverage, which pays for physical damage to your car that is not the result of a collision. For example, comprehensive coverage might pay for damage resulting from vandalism, severe weather or theft. Full Coverage Auto Insurance Can Leave You Uninsured No matter what type of auto insurance policy you choose, you want to understand what coverages it includes. Some consumers who buy a “full coverage” policy are later shocked to find out that they’ve got less insurance coverage than they thought. Just because you ask for “full coverage” does not mean you are covered for everything, and it definitely does not mean you are carrying enough coverage. Contrary to what the term suggests, “full coverage” policies do not include many types of coverage that you may need. Other benefits that frequently are not included in “full coverage” policies include: Roadside assistance; Rental […]

How to Settle Your Property Damage Claim After a Car Accident

You might be surprised to learn the frequency of accidents on Alabama roadways. According to Drive Safe Alabama, during 2017, every 11 minutes someone suffered an injury in a car accident. What you may not know is what steps you need to take to recover financially after you are the victim of a negligent driver on Alabama roadways. There are some steps you should take immediately following a car wreck, the first one being to ensure you remain safe by getting as far off the road as possible. Step One: Immediately Report the Accident Once you are certain you, and any other parties involved in the accident are safe, you should immediately call 911 for assistance. The accident must be reported to law enforcement, and you also should be checked for injuries. Step Two: Share Information and Take Photos Assuming both drivers are sufficiently aware of what is happening, you should obtain the name, address, and telephone number of the other driver as well as their insurance information. You should also gather the contact information of anyone who was witness to the accident. In addition, use your cell phone to obtain photographs of the area. The following photos and information […]

Here Are the Steps to Take After a Fall

Slips and falls are among the most common type of personal injury accidents, and they can result in long recovery periods, lost time from work and permanent disability. If you experience a slip-and-fall accident on another party’s property, it is critical that you document the situation as thoroughly as possible. Property owners have a duty to maintain their premises in a safe condition. Your thorough documentation can prove that their premises were unsafe at the time of your fall. Get Medical Attention After a slip-and-fall accident, it is imperative that you receive immediate medical attention. Either go straight to the emergency room or visit your doctor or a walk-in clinic. While this is not an issue for the seriously injured, who require prompt medical attention, a person who is hurt but adopts a “wait and see” attitude may impair their chances of receiving a settlement from the property owner’s insurance company. That’s because the insurer may claim that the injury happened elsewhere, under different circumstances, if the victim did not seek help for their injuries as soon as possible. If you wait to seek medical help, the insurer may also allege your injuries are not as serious as you claim. […]

Claims Against Nursing Homes

An aging population means that more people will become nursing home residents in the near future. Placing your loved one in a nursing home can be a hard decision, but there comes a point in many lives where nursing home care is the only option. While many nursing homes are well-run, that is not true for all nursing homes. If your loved one is in a nursing home, you want to ensure they receive good care. If you suspect a nursing home is not properly caring for your loved one, or you have evidence of abuse, report the situation to the police and contact a nursing home abuse lawyer immediately. Here are some major issues facing nursing home residents. Bedsores Bedsores are a common occurrence in nursing homes, and the development of these pressure ulcers means staff is not doing their jobs. Bedsores are preventable when nursing home staff examine and move patients with mobility issues on a regular basis. A deep bedsore may never heal completely, and they can prove fatal in a worst-case scenario. Also known as decubitus ulcers, bedsores result from pressure when a patient’s body is immobile for a long period. The constant pressure impedes blood […]

Distracted Driving Statistics

Did you know that 80 percent of automobile accidents are tied to distraction? And distraction means more than texting or using a cell phone while driving. Think of a visual distraction as doing something with your eyes closed. You would not make a turn or change lanes with your eyes closed. Yet, distracted drivers are, in effect, doing just that. Imagine driving the length of a football field at 55 mph with your eyes closed. That is the equivalent of texting while driving. Because texting takes our attention away for an average of 4.6 seconds, a driver is 23 times more likely to be involved in a crash. Consider that distracted drivers also are: Nine times more likely to have an accident if reaching for a dropped water bottle or another item while driving. Four times more likely to be in an accident if reading while driving. Three times more likely to have an accident if performing personal grooming while driving. Almost twice as likely to have an accident if eating while driving. Distracted driving statistics like these should alert all drivers to stay focused, with eyes and attention where they should be—on the road. Find more information at distraction.gov […]

Why You Should Hire a Lawyer with Courtroom Experience

Few people understand the seriousness of living with an injury sustained in a motor vehicle accident until they experience it for themselves. You may be an excellent driver, be fully insured, and keep your vehicle in excellent condition. Still, any other driver on the road can change your life forever in an instant of negligence. Suddenly, you’re missing work, medical bills are piling up, and your insurance provider’s insurance adjuster is doing his best to show you that your insurance provider is not really on your side. Anyone recovering from a personal injury after a car accident understands these things. What might be harder to understand is the importance of hiring a personal injury attorney who has courtroom experience, one who has developed a reputation for taking cases to court. You need a personal injury attorney who has experience fighting for clients in a courtroom setting. Why You Need a Personal Injury Attorney Only an experienced personal injury attorney knows the peculiarities of personal injury law. The legal system is immensely complex, and no one person can understand it fully. This is why attorneys specialize in specific aspects of the law. The Qualities of a Good Personal Injury Attorney Many […]
